• Vendors set their own prices, policies, and terms for shipping, cancellations, and refunds.

• Vendors must comply with all applicable laws, including consumer protection, tax, and safety standards.

• Vendors are responsible for fulfilling customer orders in a timely and accurate manner.

• Any disputes arising from products, services, cancellations, or refunds must be resolved directly between the vendor and the customer. ________________________________________

3. Customer Responsibility

• Customers must review vendor-specific policies before making a purchase or booking a service.

• By completing a transaction, customers agree to the vendor’s cancellation, refund, and shipping policies.

• Customers are responsible for providing accurate information (shipping address, payment details, etc.).

4. Payments

• Payments are processed securely through third-party payment providers (e.g., Stripe).

• Black Atlas does not store or control customer payment card details.

• Vendors are solely responsible for shipping and delivery of products.

• Delivery times are estimates and may vary.

• Black Atlas is not liable for shipping delays, losses, or damages caused by vendors or carriers.

6. Cancellations & Refunds

• Each vendor determines their own cancellation and refund policy.

• Customers should carefully review the vendor’s policy before completing a purchase.

• Black Atlas is not responsible for refunds or cancellations unless the issue is caused by a platform error (e.g., duplicate charge).

7. Limitation of Liability To the maximum extent permitted by law:

• Black Atlas is not responsible or liable for: o Product defects, damages, or inaccuracies.

o Vendor conduct, negligence, or policy enforcement.

o Customer misuse, disputes, or chargebacks.

o Loss of profits, data, or business opportunities arising from use of the Platform.

• Black Atlas’ liability, if any, shall be limited to the amount of fees paid to Black Atlas by the vendor or customer in the last 30 days. ________________________________________

8. Prohibited Use Users agree not to:

• Use the Platform for unlawful or fraudulent purposes.

• Infringe on intellectual property rights of Black Atlas, vendors, or third parties.

• Post false, misleading, or defamatory content.

• Attempt to hack, disrupt, or misuse the Platform.

9. Intellectual Property

• All content on the Platform (logos, designs, branding, software, etc.) belongs to Black Atlas Digital eCommerce Inc. and may not be copied, distributed, or used without permission.

• Vendors retain ownership of their product images, descriptions, and trademarks but grant Black Atlas a non-exclusive license to display their content for marketing and sales purposes.

10. Dispute Resolution

• Customers and vendors should attempt to resolve disputes directly.

• If unresolved, Black Atlas may, at its discretion, assist in mediation but is not obligated to do so.

11. Termination

3. Order Processing Time

• Vendors are expected to ship orders within the processing time stated on their storefront or product listing.

• Processing time may vary depending on product availability, customization, or location.

4. Tracking & Notifications

• Vendors must provide a tracking number (where available) once the order is shipped.

• Customers will receive email or in-app notifications with tracking details and shipping updates.

5. Delivery Delays

• Delivery timelines are estimates only and may be affected by weather, carrier delays, or vendor processing issues.

• Black Atlas is not liable for delays caused by carriers or vendors, but we encourage customers to contact the vendor directly for updates.
